Terms of Service

1. Service Provider

The Kresko Content Suite (“Service”) is operated by sendepenDAO GmbH, a company registered in Switzerland (“we”, “us”).

2. Service Description

The Kresko Content Suite is a SaaS platform for SEO content generation, optimization, translation, internal linking, and Google Search Console analytics. The Service uses third-party AI providers to process content on your behalf.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or entity may not maintain more than one free trial.

4. Subscription & Billing

  • New accounts receive a 30-day free trial with full access.
  • After the trial, a paid subscription is required to continue using the Service.
  • Subscriptions are billed monthly per organization via Stripe.
  • You may cancel at any time. Access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.

5. Your Content

  • You retain all rights to content you create, import, or generate using the Service.
  • You grant us a limited license to process your content as necessary to provide the Service (e.g., sending it to AI providers for generation or translation).
  • We do not claim ownership of any content you create with the Service.
  • You are responsible for ensuring your use of generated content complies with applicable laws.

6. Acceptable Use

You agree not to:

  • Use the Service to generate illegal, harmful, or misleading content.
  • Attempt to circumvent usage limits or billing mechanisms.
  • Share account credentials or access tokens with unauthorized parties.
  • Reverse-engineer, scrape, or interfere with the Service infrastructure.
  • Use the Service in a way that violates the terms of our third-party providers.

7. AI-Generated Content

Content generated by the Service is produced by third-party AI models (Anthropic Claude). While we strive for high quality, AI-generated content may contain errors, inaccuracies, or biases. You are responsible for reviewing and verifying all generated content before publication.

8. Availability & Support

We aim to provide reliable service but do not guarantee uninterrupted availability. Planned maintenance will be communicated in advance when possible. We provide support via email at support@kresko.agency.

9. Limitation of Liability

To the maximum extent permitted by law, sendepenDAO GmbH is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Governing Law

These terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts in Zurich, Switzerland.

12. Changes

We may update these terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance.
